KEK Design is the trade name of KEK Associates, Inc. ("KEK," "we," "us," or "our"), 100 Josons Drive, Rochester, New York 14623. These Terms of Service govern your use of kekdesign.com and any pages, forms, or content we publish on it (the "Site").

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover the website only. Design, engineering, and prototype work is governed by a separate written agreement with us. If a signed proposal, SOW, or contract conflicts with these Terms, the signed document controls for that work.

1. Who We Are

KEK is an industrial design and product development firm. The Site is provided so you can learn about our work, read our writing, and contact us.

2. Using The Site

You may view and share pages for lawful, non-commercial reference. You may not:

  • Scrape, copy, or republish the Site in bulk, or use it to train machine-learning models, without our written permission.
  • Attempt to break, overload, or probe the Site or our forms.
  • Submit false, misleading, or unlawful information through a form.
  • Imply that we endorse you, or that a portfolio piece is your work.

We may change, suspend, or take down any part of the Site at any time.

3. Portfolio, Case Studies & Other Content

Project images, names, and descriptions are for illustration. They do not disclose confidential client information we are obligated to keep private, and they are not a promise that we still work with that client or that a result will repeat.

All Site content (text, photos, renderings, video, marks, and layout) is owned by KEK or used with permission. You may not copy it for your own marketing or commercial use without our written permission.

KEK, KEK Design, and related marks are ours. Client names and logos are the property of their owners and appear for identification only.

4. Inquiries and forms

If you send a message through the Site, you ask us to reply using the contact details you provide. We handle that information as described in our Privacy Policy. Sending a form does not create a client relationship, a bid, or a confidentiality obligation beyond what the Privacy Policy and any later signed agreement say.

5. No professional advice on the Site

Nothing on the Site is engineering, legal, regulatory, or manufacturing advice, and it is not an offer to perform work. Do not rely on blog posts, process pages, or portfolio write-ups as specifications.

6. Third-Party Links & Tools

The Site may link to LinkedIn, Instagram, Facebook, X, Webflow, Google Analytics, and other third parties. Those services have their own terms. We are not responsible for them.

7. Disclaimer

The Site is provided "as is." We do not warrant that it will be uninterrupted, error-free, or current. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement as they apply to the Site.

8. Limitation Of Liability

To the fullest extent permitted by law, KEK Associates, Inc. and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Site. Our total liability for claims arising out of the Site will not exceed one hundred U.S. dollars ($100).

This section does not limit liability that New York law does not allow us to limit.

9. Indemnity

You will indemnify KEK against claims, losses, and reasonable legal fees that arise from your misuse of the Site or your breach of these Terms.

10. Privacy

Our Privacy Policy at https://www.kekdesign.com/privacy-policy explains how we collect and use information. It is part of these Terms.

11. Changes

We may update these Terms by posting a new version on this page and changing the effective date. Continued use of the Site after a change means you accept the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Monroe County, New York.
